The Board approved priority projects for the 2004A Spring Cycle at its July 12, 2004 meeting in Raleigh. Some 2004A projects approved by the Board are more time sensitive than others. CWMTF staff recommends that the Board amend the Priority List in order that contracts for time sensitive projects can be drafted and negotiated first. A draft 2004A Priority List is enclosed.

10:35 am J. Local Government Implementation of CWMTF Funded Projects – CWMTF Intern Anna Osland (Information Item)

CWMTF provides almost half of its grants, both in number and in dollars, to local governments. CWMTF Intern Anna Osland surveyed some local governments this summer. She will provide information on the strategies that successful local governments have used to complete their projects on-time and on-budget and will provide suggestions to improve grant implementation by other grantees.

10:55 am K. Funding for Donated Easement Grants – Bill Holman (Discussion Item)

The Board provided $200,000 to pay for transaction costs associated with the donations of conservation easements in fiscal year 2004-2005. At its July meeting the Board approved 3 requests for $85,850, leaving $114,150 remaining in the fiscal year 2004-2005 budget for donated easement grants. At its August meeting, the Board will consider five requests for $114,200. In addition, CWMTF has received 5 more requests totaling $102,400 which have not yet been reviewed.

The Board could: 1) maintain its cap of $200,000 for donated easements in 2004-2005 and not fund any more requests, 2) provide an additional $200,000 at its September meeting for a total of $400,000 in fiscal year 2004-2005, 3) provide an additional $200,000 at its November meeting when it prioritizes 2004B projects, or 4) consider other alternatives.

11:05 am L. 2004D-004 – Pamlico-Tar River Foundation’s Allan Tract on the Pamlico River – Leland Heath (Action Item)

On June 23, 2004 the Pamlico-Tar River Foundation requested up to $16,000 for transaction costs associated with the fee simple donation of 2 adjacent tracts totaling 5.22 acres along the Pamlico River near the mouth of Blounts Bay in Beaufort County. Mr. Russell Allan will donate the property to PTRF. PTRF will own the property and donate a conservation easement to the State of North Carolina. CWMTF staff has reviewed the request, believes it qualifies, and recommends funding up to $16,000.

11:10 am M. 2004D-005 – National Committee for the New River’s Joyner Tract on Big Horse Creek – Bern Schumak (Action Item)

On July 7, 2004 the National Committee for the New River requested up to $23,200 for transaction costs associated with the donation of a conservation easement on approximately 38 acres of a 75-acre tract along Big Horse Creek in the North Fork New River watershed in Ashe County. The National Committee will hold the easement. Agricultural practices and the building of a future home may continue on the remainder of the tract. CWMTF staff has reviewed the request, believes it qualifies, and recommends funding up to $23,200.

11:15 am N. 2004D-006 – Blue Ridge Rural Land Trust’s Dishman Tract on the Watauga River – Tom Massie (Action Item)

On July 8, 2004 the BRRLT requested up to $25,000 for transaction costs associated with the donation of a conservation easement on the 50-acre Dishman property along the Watauga River in Watauga County. BRRLT will hold the easement. Forest management practices may continue under appropriate best management practices. CWMTF staff has reviewed the request, believes it qualifies, and recommends funding up to $25,000.

11:20 am O. 2004D-008 – North Carolina Coastal Land Trust’s Henry Tract on Town Creek – Nancy Guthrie (Action Item)

On July 19, 2004 the NCCLT requested up to $25,000 for transaction costs associated with the donation of a 64-acre conservation easement on the entire Henry tract along Town Creek in Brunswick County. NCCLT will hold the easement. CWMTF staff has reviewed the request, believes it qualifies, and recommends funding up to $25,000.

11:25 am P. 2004D-009 – Blue Ridge Rural Land Trust’s McCarthy Tract on Little Glade Creek River – Bern Schumak (Action Item)

On July 12, 2004 the BRRLT requested up to $25,000 for transaction costs associated with the donation of a conservation easement on the 51-acre McCarthey property along Little Glade Creek in Alleghany County. BRRLT will hold the easement. Agricultural and forest management practices may continue under appropriate best management practices. CWMTF staff has reviewed the request, believes it qualifies, and recommends funding up to $24,950, which will utilize all funds remaining for donated easements in the fiscal year 2004-2005 budget.

The Burke County Board of Commissioners has invited CWMTF Trustees, guests, staff, and community leaders to the home of Mike and Joella Fulenwider at 2590 Laurel Pointe Drive on Lake James for a buffet and music from 7:00 – 9:00 pm on Sunday, August 8. Parking is not available at the Fulenwider’s home. Shuttle service will be provided from the Canal Bridge Public Access Area on Lake James and NC Highway 126 starting at 6:30 pm and ending at 9:15 pm. Detailed directions to the Fulenwider’s home are included in the CWMTF Board packet.

The NC Division of Parks & Recreation has invited CWMTF Trustees, guests, and staff to paddle the Catawba River from Lake James to Watermill on Saturday, August 7. Meet at the Bridgewater Public Access Area on Powerhouse Road below the Linville River Dam on Lake James at 12 noon. Use same directions to the Fulenwider’s home except turn right on NC Highway 126 from Benfields Landing Road (SR 1234)( instead of left towards Canal Bridge Access) and turn right on Powerhouse Road before Hwy 126 crosses the Linville River. Call Lake James State Park at 828-652-5047 if you need better directions. Our foul weather backup plan will to meet at Bridgewater Access at noon and tour the area by vehicle.

The City of Morganton and Town of Valdese have invited CWMTF Trustees, guests, and staff to a reception at 6:00 pm and dinner at 7:00 pm on Saturday, August 7 at J. Barton’s Steakhouse on the Catawba River at 315 Sanford Drive in Morganton.

The NC Division of Parks & Recreation has invited CWMTF Trustees, guests, and staff to tour Lake James and the potential expansion of Lake James State Park (CWMTF Project #2004B-038) and State Gamelands (CWMTF Project #2004B-015) by boat from 9:00 am – 12 noon on Sunday, August 8. Meet at Lake James State Park at 9:00 or carpool from the Hampton Inn. We’ll leave the Hampton Inn at 8:15 am. Use same directions as to Fulenwider’s home except keep going on Highway 126 past Canal Bridge Public Access until you reach the entrance to the Park. The Board of Trustees of CWMTF will meet on September 12-13 in Kinston, October 10-11 in Greensboro, and November 14-15 in Raleigh.

The DENR/Division of Water Quality has published the 2003 Lumber River and 2004 Tar-Pamlico River Basinwide Water Quality Plans. Contact http://h2o.enr.state.nc.us/basinwide/ or Robin Markham at 919-733-5083 ext 558 for copies.

The DENR/Division of Water Quality released and held public meetings on the draft Catawba River Basinwide Water Quality Plan in July. Twenty-two percent of the monitored streams in the basin are too impaired to support aquatic life. Five years ago 16% were impaired. Verbal and written comments will be accepted until August 13, 2004.

The DENR/Division of Marine Fisheries has released and is holding public meetings on the draft Coastal Habitat Protection Plan (CHHP). The Environmental Management Commission, Coastal Resources Commission, and Marine Fisheries Commission plan to jointly review and adopt the plan on September 9.

The U.S. Army Corps of Engineers is beginning a reconnaissance study of the Tar River Basin and Pamlico Sound to determine whether planning for flood damage reduction, environmental restoration and protection, and related purposes is needed. Please send initial comments by August 15, 2004 to US Army Corps of Engineers, Wilmington District, Attention CESAW-PM-C/Clay, Box 1890, Wilmington, NC 28402-1890. The Pamlico-Tar River Foundation’s annual meeting is at 7:00 pm on September 15 in Greenville. Tom Reeder will speak on Swift Creek and site specific habitat protection.

Ducks Unlimited will kick off its Sound CARE initiative on September 17, 2004 at the NC Museum of Natural Sciences in Raleigh. Ducks Unlimited has set a goal of conserving 22,000 acres of wetland habitat in North Carolina over the next five years. 1) General Contracts Status
2) Tryon Palace Historic Site and Gardens (1998B-705) – This project has been under contract since Aug. 15, 1999, in the amount of $1,000,000. In 2003 the grantee had to redesign the project since the US Army Corps of Engineers did not approve the first design; the grantee wrote to CWMTF in Aug. 2003 assuring that the project would be bid in the fall of 2003, and the contract was extended once based on those assurances. However, the next design was not submitted for permitting until April 2004 and the permits have not yet been issued. An email dated July 23, 2004 provides more details on the project status. No grant funds have been spent. This contract will expire on Dec. 15, 2004. CWMTF staff seeks guidance from the Board on under what circumstances this contract should be extended and on establishing a firm ending date.

When CWMTF funds stream restoration and stormwater projects on private property or on local government property, it requires a permanent conservation easement in favor of the State to protect the State’s investment. At its March 18, 2002 meeting in Cornelius the Board provided more flexibility for installation of best management practices on agricultural lands.

In October 2003, the Board approved up to $12,000 to fund the cost of a “mail-out” customer survey to be developed by Dr. Toddi Steelman with NC State University, with oversight by the Long Range Planning Committee. At its July 12, 2004 meeting, the Committee discussed NCSU’s right to use the data, which could include information in support of a master’s thesis or other publications. Staff has discussed this matter with NCSU and will present more information. The Committee should recommend to the Board on whether or not to proceed with a contract with NCSU for this work.

4:45 pm D-C. Review of Doc Klein’s Recommendations Based on Interviews of Board and Staff –Committee Chair Karen Cragnolin (Action Item)

Doc Klein presented 11 recommendations to the Board at its July 12, 2004 meeting based on his interviews of Board and staff. CWMTF Staff recommends that the Committee review the recommendations and select 2 to 3 to set as priorities to begin working on. The next step will be a work session or "mini-retreat" with the full Board at a future meeting (October?) to start work on the first priority as recommended by the Committee.

1) Compensation Increase Passed by General Assembly

The 2004 General Assembly enacted and Governor Easley signed HB1414, 2004 Appropriations Act. HB 1414 provides salary increases of $1000 or 2.5%, whichever is greater, for most state employees retroactive to July 1, 2004. The CWMTF Executive and Deputy Director recommend that the Board approve the same salary increase for CWMTF staff as the General Assembly and the Governor. A draft resolution is enclosed.

At its January 12, 2004 meeting the Board approved in-range salary adjustments for CWMTF Field Representatives, the Senior Water Quality Advisor, and Administrative Officer to address equity and to remain competitive with similar state programs.

After reviewing performance, equity, and competition the Executive Director recommends that the Board approve in-range salary adjustments for the Deputy Director, Water Quality Advisor, Public Information Officer, and Executive Assistant effective September 1, 2004.
