CWMTF Announcements

Chairman Howard has determined that setting priorities for funding 2005A Spring Cycle Projects is the priority for the August Board of Trustees meeting. Other committee work may be postponed to provide adequate time for committee and Board decisions on prioritizing and funding projects.

Mecklenburg County Storm Water Services has invited CWMTF Trustees, guests, and staff to tour proposed stormwater best management practices in the Town of Huntersville on Saturday, August 6. The tour will begin at the Hawthorne Suites/Quality Inn at 16905 Caldwell Creek Drive at 1:00 pm.

Mountain Island LakeKeeper Pam Beck has invited CWMTF Trustees, guests, and staff to learn about local and state efforts to protect the Mountain Island Lake regional drinking water supply on Saturday, August 6. The tour will leave at 3:00 pm from the Hawthorne Suites/Quality Inn.

CWMTF Committees and the Board will meet at the Lee S. Dukes, Jr./North Mecklenburg Water Treatment Plant and Blue Planet Environmental Education Facility at 7980 Babe Stilwell Road in Huntersville on Sunday, August 7 and Monday, August 8.

Directions :    

1.   Take I-77 North to Exit 25 (same exit as Hawthorne Suites/Quality Inn).

2.   Turn left at the top of the ramp on Sam Furr Road (highway 73).  

3.   Drive 3 miles on Highway 73

The CWMTF Infrastructure/Wastewater Committee will meet at 12:30 am on Sunday, August 7 at the Lee Dukes Water Treatment Plant in Huntersville.

The CWMTF Restoration/Stormwater Committee will meet at 1:10 on Sunday, August 7 at the Lee Dukes Water Treatment Plant in Huntersville.

Mecklenburg Storm Water Services has invited CWMTF Trustees, guests, and staff to tour the restoration of Little Sugar Creek and Sugar Creek in uptown Charlotte. The tour will leave from the Hawthorne Suites/Quality Inn at 4:30 pm on Sunday, August 7.  

The CWMTF Budget Committee will meet at 7:55 am on Monday, August 8 at the Lee Dukes Water Treatment Plant in Huntersville.

CWMTF Committee meetings will begin upon the conclusion of the previous Committee meeting and may start before or after the time shown on the agenda.

All CWMTF Committee meetings are open to the public; all Trustees are welcome.

The Catawba Lands Conservancy has invited CWMTF Trustees, guests, and staff, and local officials to dinner at the Brickhouse Tavern at 208 Delburg Street in Davidson (Exit 30 off I-77, 704-987-2022) at 7:00 pm on Sunday, August 7.

The Land Trust for Central NC has invited CWMTF Trustees, staff and guests to tour the proposed new NC Wildlife Resources Commission Gameland on Second Creek in the Yadkin/Pee Dee River Basin in Rowan County (CWMTF #2005A-022) after the Board meeting on Monday, August 8.

The Board of Trustees of CWMTF will meet September 11-12 at Lake Lure in Rutherford County, October 9-10 in Edenton, and November 13-14 in Raleigh.

The next deadline for applications for grants from CWMTF is December 1, 2005.

The Water Resources Research Institute of the University of North Carolina has named Dr. David Moreau as Director, effective July 1, 2005. Moreau replaces Dr. Ken Reckhow of Duke University. Dr. Greg Jennings, Associate Director of WRRI, served as Interim Director. Dr. Moreau also chairs the NC Environmental Management Commission. Contact www.ncsu.edu/wrri/ .

The NC Division of Water Quality will hold a public meeting on August 2 from 4:00 - 8:00 pm at the NC Cooperative Extension Service Center in Jefferson in Ashe County on the draft plan. 10:35 am             I-B. 2004B-054 - Triangle Land Conservancy's Marks Creek II Project - Leland Heath (Action Item)

The Triangle Land Conservancy wrote CWMTF on June 29, 2005 and asked the Board to accept withdrawal of its application on Marks Creek. CWMTF staff recommends that the Board approve TLC's request.

10:37 am             I-C. 2005A-011 - NC Coastal Land Trust's Blue Fin Marina on North River Project - Damon Tatem (Action Item)

The NC Coastal Land Trust wrote CWMTF on June 29, 2005 and asked the Board to defer its application to acquire the Blue Fin Marina on the North River in Currituck County. Currituck County may acquire the tract. CWMTF staff recommends that the Board approve NCCLT's request.

10:39 am             I-D. 2005A-015 - NC Division of Parks & Recreation's Carvers Creek II Project - Nancy Guthrie (Action Item)

On July 5, 2005 The Nature Conservancy advised the Division of Parks & Recreation and its partners that the owners of the Carvers Creek II tract were not willing to sell at this time.   CWMTF staff recommends that the Board defer this project until November 2005.  

10:41 am             I-E. 2005A-020 - NC Wildlife Resources Commission's Folkstone-Beck 2 tract - Damon Tatem (Action Item)

On July 7, 2005 The Nature Conservancy on behalf of the NC Wildlife Resources Commission wrote CWMTF to request that amendments to the scope and budget of the project. The Padgett tract is no longer available. TNC updated its budget on July 14, 2005. TNC requests an amended amount of up to $1,091,235.

CWMTF staff recommends that the Board approve TNC/WRC's request up to $1,092,000. The Navy will provide matching funds.

10:45 am             I-F.   2005A Project Budget Amendments - Bill Holman & CWMTF Staff (Action Items)

•  2005A-005 - Goldsboro/Wayne County's Clean Water/Seymour Johnson Air Force Base Protection Project Phase II ($4,549,000)

The Board approved a grant of up to $1,737,000 to Goldsboro/Wayne County in July 2004 to help protect water quality and Seymour Johnson Air Force Base (Phase I - CWMTF #2004A-007).

Goldsboro/Wayne County and their contractors have contacted landowners and have begun negotiations to close on properties identified in Phase I.

CWMTF staff recommends that the budget of Goldsboro/Wayne County's Phase II application (CWMTF #2005A-005) be reduced from $4,549,000 to $3,000,000 and that Goldsboro/Wayne County reapply to CWMTF in 2006 for Phase III subject to progress on implementation of Phases I & II.

Contracts for CWMTF #2004A-007 and CWMTF #2005A-005 may be combined so that Goldsboro/Wayne County has the flexibility to close on properties held by willing sellers in accident potential zones one and two and within noise contours.

•  2005A-010 - The Nature Conservancy's Troutman Tract on Drowning Creek at Camp McCall/Fort Bragg/Pope ($651,000)

CWMTF staff recommends that the budget of The Nature Conservancy's Troutman Tract on Drowning Creek be reduced from $651,000 to $475,000. The Army has increased its match.

•  CWMTF staff recommends that the Board approve up to $8,592,000 in new special indebtedness authorized by Session Law 2004-179 to fund the following projects (Principal & interest payments on $8,600,000 range from $817,000/year at 4.5% to $937,400 per year at 5.9%.   The State Treasurer will probably sell bonds in the 2 nd quarter of calendar year 2006.):

i. 2005A-012 - NC Coastal Land Trust's Cherry Point/Piney Island Protection Projects ($3,000,000)

 ii. 2005A-019 - NC Division of Parks & Recreation's Sandy Run Savannah and Shelter Swamp (Brunswick Timber) at Camp Lejeune ($4,500,000)

 iii. 2005A-020 - NC Wildlife Resources Commission's Beck 2 @ Folkstone at Camp Lejeune ($1,092,000)

•  CWMTF staff recommends that the Board fund up to $3,713,000 for the following projects:

 i. 2005A-005 - Goldsboro/Wayne County's Seymour Johnson Protection Project Phase II ($3,000,000)

 ii. 2005A-008 - NC Wildlife Resources Commission's Adirondack tract at Camp Lejeune ($238,000)

 iii. 2005A-010 - The Nature Conservancy's Troutman Tract on Drowning Creek at Camp McCall/Fort Bragg/Pope ($475,000)

•  CWMTF staff recommends that the Board defer the following clean water/military protection projects pending action by the Boards of the Natural Heritage Trust Fund and the Parks & Recreation Trust Fund and the Ecosystem Enhancement Program later this year:

i. 2004B-036 - NC Division of Parks & Recreation's Carvers Creek I/Clark I at Fort Bragg/Pope ($2,331,000)

ii. 2005A-009 - The Nature Conservancy's Corbett tract at Camp Lejeune ($1,516,000)

 iii. 2005A-025 - NC Wildlife Resources Commission's Upchurch tract on Nicholson Creek at Fort Bragg/Pope ($714,000)

iv. 2005A-028 -Sandhills Area Land Trust's Glenn tract on the Little River at Fort Bragg/Pope ($67,000)

11:30 am             I-H.   2002A-305 - Division of Soil & Water Conservation's Conservation Reserve Enhancement Program (CREP) - Leland Heath (Discussion and Potential Action Item)  

In November 2003 the Board approved a grant of up to $4,200,000 to the Division of Soil & Water Conservation to fund phase II of CREP. On July 8, 2005 DENR Secretary Bill Ross asked the Board to approve the Division of Soil & Water Conservation's request to decrease best management practices by 163,119 and District Administration by $358,820 and increase easement acquisition by $457,939 and Division Administration by $64,000.

At its July 11, 2005 meeting in Cary the Board voted to table the request until its August 2005 meeting.  

On July 27, 2005 the Division of Soil & Water Conservation (DSWC) projected that it will run out of funds to acquire easements by the end of August 2005 at its current pace of closings unless the Board approves its request.

On July 27 DWSC also requested an additional grant of $400,000 from CWMTF for CREP to operate until the end of December 2005. DSWC projected that it would run out of funds by the end of October 2005 at its current pace of closings unless the Board provides an additional $400,000.

The Board deferred DSWC's request for funds for CREP Phase III in 2004 (CWMTF #2004B-040).   The Board will consider a revised application and budget for CREP Phase III in the 2005B Fall Cycle.

11:40 am             I-I. Donated Easement Grant Policy - Bill Holman (Discussion Item)

The Board adopted a donated easement program in March 2004 to provide transaction costs for the donations of conservation easements that protect water quality. The Board's policy requires that the value of the conservation easement be greater than the transaction costs. At its July 11, 2005 meeting in Cary the Board requested more information about the value of donated conservation easements. CWMTF staff recommends that the Board consider amending its policy and require that the value of the conservation easement be at least $50,000 (twice the cost of the donated easement grant).

11:50 am             I-J. Funding for 2005 Donated Easement and 2005 Mini-Grants - Bill Holman & Francine Durso (Action Item)

At its July 11, 2005 meeting in Cary the Board approved nine donated easement grants and three mini-grants subject to receiving an approved budget.

As of July 28 the General Assembly had not enacted and the Governor had not signed a biennial budget. However, CWMTF received an allotment of $5,166,667 ($62,000,000/12 months) from the Office of State Budget and Management in July and will continue to receive allotments until the General Assembly enacts and the Governor signs a new budget.

CWMTF staff recommends that the Board give final approval to the nine donated easement grants and three mini-grants that it approved in July.

12:00 pm             I-K. 1997A-012, 2003D-010, 2005D-010, 2005D-011 - Waynesville's Allen Creek Water Supply Watershed Protection - Tom Massie (Action Item)

The Board approved a grant of $500,000 to the Town of Waynesville in Haywood County in the French Broad River Basin to acquire inholdings in the Allen Creek Water Supply Watershed in 1997. The Town provided matching funds to acquire the inholdings and committed to donate a conservation easement on its entire 7340-acre watershed to the State and two land trusts. The Southern Appalachian Highlands Conservancy and Conservation Trust for NC will jointly monitor and steward the watershed. The Town will manage the land that it acquired with its own funds as a working forest.

The Board approved a grant of up to $25,000 (CWMTF #2003D-010) in January 2004 to assist the Town with the costs of surveying the 8000-acre watershed.

The Town does not want to provide funding for permanent stewardship of the conservation easement.

On July 11, 2005 the Conservation Trust for North Carolina requested $25,000 for stewardship of the Allen Creek watershed (CWMTF #2005D-010).

On July 15, 2005 the Southern Appalachian Highlands Conservancy requested $25,000 for stewardship of the Allen Creek watershed (CWMTF #2005D-011).

On July 14, 2005 the Town of Waynesville wrote CWMTF and advised that it would willing to forego the $25,000 that CWMTF provided for survey costs (CWMTF #2003D-010) if CWMTF provided funds for stewardship of the conservation easement.

CWMTF staff recommends that the Board accept the Town's proposal to cancel the donated easement grant of up to $25,000 to the Town (CWMTF #2003D-010) and approve CTNC and SAHC's request for stewardship funds (CWMTF #2005D-010 and CWMTF #2005D-011). CWMTF will not provide stewardship funds until the Board adopts a policy on stewardship of conservation easements.

The Board approved nine donated easement grants for up to $197,000 at its July meeting. At least $203,000 remains available for donated easement grants in fiscal year 2005-2006.

12:10 pm             I-L. 2005M-004 - Conservation Trust for North Carolina's Lankford tract on Boones Fork Creek - Tom Massie (Action Item)

The Conservation Trust for NC wrote CWTMF on July 18, 2005 to request a mini-grant of up to $25,000 to provide pre-acquisition costs associated with acquisition of the Lankford tract on Boones Fork Creek in the Watauga River Basin in Watauga County.   CWMTF staff is reviewing the request and will make a recommendation to the Committee and Board at the August meeting.  

The Board approved three mini-grants for up to $75,000 in July. $125,000 remains available for mini-grants in fiscal year 2005-2006.

12:15 pm             I-M. 2004B-021 - Lumber River Conservancy's Upper Lumber River Tracts - Nancy Guthrie (Action Item)

In November 2004 the Board approved a grant of up to $304,000 to assist the Lumber River Conservancy with the acquisition of several tracts on the Lumber River in Scotland County. On July 1, 2005 the Lumber River Conservancy requested that up to $153,000 be transferred from the purchase of the Stone/Bray tract to fund acquisition of the Hunt/Maynor tract (CWMTF #2005B-019) and Slaughter tract (CWMTF #2005B-021).   The Lumber River Conservancy requested $187,400 to acquire the Hunt/Maynor tract and $56,088 to acquire the Slaughter tract from CWMTF on June 1, 2005. The Board is scheduled to review both applications at its September 11-12, 2005 meeting.

CWMTF staff recommends that the Board not approve LRC's request because neither the staff nor the Board have reviewed or prioritized the Hunt/Maynor or Slaughter tracts. CWMTF staff recommends that the Board approve the use of up to $50,000 ($25,000 per tract) from 2004B-021 to assist LRC with the preacquisition costs associated with purchase of the Hunt/Maynor and Slaughter tracts.

CWMTF's typically requires donation of a permanent conservation easement to the State to protect the State's investment in restoration and stormwater projects. The Board has also allowed soil and water conservation districts to hold and monitor conservation easements for stream restoration projects.   Some districts are willing to hold and monitor conservation easements and some are not.

CWMTF requires land trusts to name another land trust to steward conservation easements if they go out of business.   Should CWMTF require districts and other local government units to name a back up easement holder and steward if a future district or unit decides to not hold and monitor the easement?

Donating a conservation easement to the State for a restoration or stormwater project sometimes increases delay and costs - particularly in urban areas. CWMTF staff recommends that the Board allow local governments that have demonstrated a commitment to long-term management and stewardship to hold conservation easements on a case-by-case basis.
