SB 264, 2006 Appointments, by Senator Rand and others, reappoints Trustees Karen Cragnolin, Charles Johnson, Claudette Weston, and Jerry Wright to four-year terms expiring on July 1, 2010 and appoints Dr. Norman Camp III of Wake County for a term expiring on July 1, 2007 to fill the unexpired term on Leroy Smith and C.L. "Rance" Henderson of Burke County for a term expiring on July 1, 2008 to fill the unexpired term of Tony Lathrop.

August 3 marks the 10th anniversary of the establishment of the Clean Water Management Trust Fund by the General Assembly of North Carolina (Section 27.6 of HB 53, 1996 Appropriations Act).

Governor Easley has reappointed Jonathan Howes of Chapel Hill as Chairman of the Parks & Recreation Authority.  

The Board of Trustees of Audubon North Carolina elected Jonathan Howes Chairman in July. He succeeds Phil Manning.

House Speaker Jim Black has appointed Lisa Weston of Gaston County to the Parks & Recreation Authority for a term expiring on June 30, 2009.

Wake County named Christopher Snow as Director of Parks, Recreation, and Open Space in July.

The State Water Infrastructure Commission (SWIC) will meet on August 22, 2006 at 2:00 pm at the Coates Center in Raleigh. SWIC will also meet on September 25, October 23 and November 27.

At its meetings on June 5 and June 26, 2006 the committee discussed and debated several ideas to improve the efficiency and effectiveness of CWMTF trustees and staff including screening mediocre projects, screening projects that are not ready to go, allocating funds by committee and holding 20-30% for contingency and statewide projects, funding construction projects in a design & permit phase and a construction phase, accepting applications once per year, reviewing applications only once, reducing the number of Board meetings, standardizing contracts, requiring milestones/schedules to be meet by grantees to maintain their funds, devoting more time to policy issues and less to administrative issues, and other ideas.

In December 2005 The Nature Conservancy requested almost $55,603,000 from CWMTF to help acquire more than 76,000 acres from International Paper (IP) in the Chowan, Juniper Creek, Lower Roanoke, Upper Roanoke, Upper Tar, and Fishing Creek watersheds.

At its July 9-10, 2006 meeting in Raleigh the Board asked CWMTF staff to work with The Nature Conservancy, Wildlife Resources Commission, and the Natural Heritage Trust Fund to develop a proposal for CWMTF to fund about $16,000,000 of the IP tracts in fiscal year 2006-2007 for the Board to review at its August 13-14 meeting.   The Board asked the staffs to consider water quality benefits, the timing of matching funds, and other issues. CWMTF, TNC, WRC, and NHTF met on July 24 in Raleigh. A list of IP tracts with high water quality benefits that could close in fiscal year 2006-2007 is in the Board packet. The value of the land is $14,956,294, transaction costs are up to $250,000; interest costs are up to $760,315 for a total cost of $15,967,000 (rounded up).

At its July 9, 2006 meeting the committee voted to oppose waiving CWMTF's prohibition on subdivision of conservation easements. At its July 10, 2006 meeting the Board adopted a substitute motion to defer this issue until the August Board meeting in order to receive a recommendation from the Wildlife Resources Commission (WRC).

Mark Fowlkes, Watershed Enhancement Biologist, for WRC wrote WRC Commissioner Charles Bennett on July 7, 2006 with a recommendation. Jim Borawa, Watershed Enhancement Group Supervisor, for WRC plans to attend the committee meeting and will be available to respond to questions and concerns.

CWMTF staff recommends that the Board designate WRC as the lead State agency on this matter and ask WRC to keep CWMTF informed on the resolution of this issue.

12:45 pm       P-D. 2004A-012 - NC Coastal Land Trust's Fletcher Tract/The Preserve in Pitt County - Robin Hammond & Leland Heath (Potential Action Item)

In 2004 the Board approved a grant of up to $241,000 to assist the NC Coastal Land Trust (NCCLT) with acquisition of a conservation easement on 178 acres of floodplain and 25 acres of uplands in Pitt County on the Tar River in a conservation subdivision project. NCCLT implemented the project.

Pitt County's Subdivision Ordinance requires compliance with its rules for subdivisions of land into parcels of ten acres or less. Its rules require a paved road to be built to State standards.

On June 18, 2006 Mr. Fred Fletcher, Jr., the property owner, requested permission from CWMTF to subdivide the property (CWMTF's standard conservation easement prohibits subdivision without permission.) and to further reduce the density of his project from 9 lots to 4 lots, including an existing residence. The change would increase the size of the lots such that a paved road built to State standards would not be required. NCCLT supports Mr. Fletcher's request.

If the subdivision results in the release of any area from the CWMTF conservation easement, the request will have to be reviewed and approved by the Council of State.   

At the July 9-10, 2006 Board meeting CWMTF staff recommended that Mr. Fletcher prepare the draft documents to amend the conservation easement and to provide a map illustrating his request. The Committee and Board voted to defer the request until documents and a map were provided.

Mr. Fletcher has submitted maps illustrating his request. These maps will be available for review at the August meeting. Mr. Fletcher has requested that the Board decide if it supports his request in concept. If the Board approves his request, Mr. Fletcher will draft the conservation easement amendment for review by the Board in September. The Council of State must also approve the request.         

12:50 pm       P-E. 2005B-048 - Tar River Land Conservancy's Blackley Farm Project - Leland Heath (Action Item)

In November 2005 the Board approved a grant of up to $527,000 to the Tar River Land Conservancy (TRLC) to match US Farm & Ranchland Protection Funds to acquire a conservation easement on the 375-acre Blackley Farm in Granville County in the Tar-Pamlico River Basin.

On June 19, 2006 TRLC wrote CWMTF to advise that the proposed total conservation easement has been reduced from about 373 acres to about 266 acres and that the proposed CWMTF riparian buffer easement has been reduced from about 152 acres to about 97 acres after consultations with the US Natural Resources Conservation Service (NRCS). The project is not yet under contract.

At its July 9, 2006 meeting in Raleigh the Committee voted to tell TRLC to accept the current scope of work or to reapply in December 2006. On July 10, 2006 the Board adopted a substitute motion to defer the request until the August meeting and to consider prorating the grant award based on the difference in buffer length between the original project and the revised project, which is around 11%.

On July 13, 2006 TRLC requested an amended scope and budget for the project. The proposed budget is $471,000 or $56,000 less than the grant award. CWMTF staff recommends that the Board approve TRLC's amended scope and budget.

1:00 pm          P-F. 2004A-032 - NC Coastal Land Trust's Springer's Point/McWillams Tract on Ocracoke Island ­ Damon Tatem (Action Item)

In 2004 the Board approved a grant of up to $2,161,000 to the NC Coastal Land Trust (NCCLT) to assist with the acquisition of the McMillams Tract on Ocracoke Island in Hyde County. NCCLT used a $25,000 federal grant and in-kind corporate contributions to remove non-native ivy and other vegetation and to restore native plants on the site. $4700 remains in the grant. NCCLT would like to use the remaining $4700 for one additional łtouch up˛ treatment of non-native vegetation (with herbicide) this fall or next spring.

Restoration of native vegetation benefits the environment but is a primarily a management issue rather than an acquisition issue or stewardship issue.   CWMTF staff seeks guidance from the Board on whether this is an appropriate use of CWMTF funds.

1:10 pm          P-G. 2004B-029 - NC Coastal Land Trust's Davis Tract on the Cape Fear River ­ Nancy Guthrie (Action Item)

In 2005 the Board approved a grant of up to $1,556,000 to the NC Coastal Land Trust to acquire a CWMTF conservation easement on 89 acres to be matched by a donation of a conservation easement on 64 acres valued at $721,000 to NCCLT for a total of 153 acres on the Davis Tract in Brunswick County. Although the property has not been surveyed NCCLT's GIS specialist advises that the total property may only be 136 acres.

On July 14, 2006 NCCLT requested that the CWMTF conservation easement be increased to about 100 acres and that the donated conservation easement be reduced to about 36 acres, subject to survey and confirmation of values by the State Property Office. NCCLT is not requesting a change in the budget.

CWMTF staff recommends that the Board approve NCCLT's request.

1:15 pm          P-H. 2006D-002 - Tar River Land Conservancy's Marsha Morton Tract on Fox Creek - Leland Heath (Action Item)

On July 13, 2006 the Tar River Land Conservancy (TRLC) requested up to $25,000 from CWMTF to pay for transaction costs associated with the donation of a conservation easement on a 181-acre tract owned by Ms. Martha Morton on Fox Creek in Granville County in the Tar-Pamlico River Basin.   TRLC will hold the easement. TRLC estimates the value of the conservation easement to be $325,800. CWMTF staff will visit the site and make a recommendation at the August meeting.

If the Board approves TRLC's request, $451,600 will remain available for donated easement grants in fiscal year 2006-2007.

1:20 pm          P-I. 2006D-003 - Tar River Land Conservancy's Goodfred Tract on Tar River - Leland Heath (Action Item)

On July 14, 2006 the Tar River Land Conservancy (TRLC) requested up to $24,700 from CWMTF to pay for transaction costs associated with the donation of a conservation easement on 71 acres owned by Mr. Mike Goodfred on the Tar River and on a cypress lake in Edgecombe County in the Tar-Pamlico River Basin. TRLC will hold the easement. TRLC estimates the value of the conservation easement to be $588,000. CWMTF staff will visit the site and make a recommendation at the August meeting.

If the Board approves TRLC's request, $426,900 will remain available for donated easement grants in fiscal year 2006-2007.

1:25 pm          P-J. 2006D-004 - Tar River Land Conservancy's Jane Morton Tract on Fox Creek - Leland Heath (Action Item)

On July 13, 2006 the Tar River Land Conservancy (TRLC) requested up to $24,840 from CWMTF to pay for transaction costs associated with the donation of a conservation easement on 320 acres owned by Ms. Jane Morton on Fox Creek in Granville County in the Tar-Pamlico River Basin. TRLC will hold the easement. TRLC estimates the value of the conservation easement to be $512,000. CWMTF staff will visit the site and make a recommendation at the August meeting.

If the Board approves TRLC's request, $402,060 will remain available for donated easement grants in fiscal year 2006-2007.

1:30 pm          P-K. 2006M-002 - Triangle Greenways Council's St. Ambrose Church Tract on Walnut Creek - Nancy Guthrie (Action Item)

On July 25, 2006 the Triangle Greenways Council requested up to $25,000 for a Mini-Grant for the pre-acquisition costs associated with the acquisition of 4 acres from St. Ambrose Church on Walnut Creek in Wake County in the Neuse River Basin. CWMTF staff has reviewed the request, visited the site, determined that it meets the Board's criteria for mini-grants and recommends that the Board approve TGC's request.  

If the Board approves TGC's request, $150,000 will remain available for mini-grants in fiscal year 2006-2007.

6:15 pm          R-A. 2002A-406 - Town of Wake Forest's Richland Creek Restoration & Greenway Project - Robin Hammond (Potential Action Item)

In 2002 the Board approved a grant of up to $240,000 to the Town of Wake Forest in the Neuse River Basin to help restore Richland Creek and to establish a greenway. The Town has not expended any CWMTF funds to date. However the Town has recently submitted numerous requests for reimbursement.

The grant agreement requires the Town to place 67 acres of riparian buffer and 12 acres of high quality wetlands under conservation easement. Mill Creek Associates, Inc., owns eight parcels within the project area. These parcels are part of a residential subdivision. The Town's attorney wrote CWMTF to advise after lengthy negotiations between the Town and Mill Creek Associates, the easements had been or will be dedicated on recorded maps, but the owner will not execute a CWMTF conservation easement.   The town attorney also stated that the areas in contention are not part of the proposed buffer requiring restoration or construction work, but simply area needed to satisfy the total acreage requirement of the grant agreement.

The town attorney further advised that the total amount of linear footage to be protected has been obtained without these easements.   At its July 9-10, 2006 meeting in Raleigh the Committee and the Board considered a request from the Town to dedicate conservation easements on recorded maps instead of recording a CWMTF easement. The Board deferred the matter to the August meeting to allow the Committee an opportunity to review the original application. The original application was mailed to the Committee on July 25, 2006. Maps illustrating the conservation easements at issue were displayed at the July meeting. Two (2) of the maps have already been recorded; the remaining five (5) have not.

Issues the Committee may wish to consider when evaluating this request include the following:   1) does approval of this request set an unwise precedent; 2) is there sufficient information on the maps to understand the terms and conditions of the easements and to enforce them; 3) what extrinsic information is needed and available to amplify the terms of the easements: 4) how can the easements be amended or terminated; 5) who can terminate or amend the easements; 6) is dedicating easements on recorded maps more efficient than recording conservation easements; and 7) other issues.

6:30 pm          R-B. 2006A-703 ­ Town of Kitty Hawk's Kitty Hawk Bay Project - Damon Tatem (Action Item)

On July 20, 2006 the Town of Kitty Hawk wrote CWMTF to request that 2006A-703 be withdrawn. Kitty Hawk applied in June 2006 with a redesigned project - 2006B-706. CWMTF staff recommends that the Board approve Kitty Hawk's request.
