
Clean Water Management Trust Fund Draft Resolution

SECOND DRAFT Resolution – Setting Criteria for Phasing of Funding for Certain Multi-Year Projects
1.
Whereas, the Board of Trustees of the Clean Water Management Trust Fund
has funded a number of projects that are implemented in phases over
several years;
2.
Whereas, many wastewater, stormwater and restoration projects require
planning, design, permitting and multiple construction phases; 3. Whereas, the acquisition of land and conservation easements may be phased due to the need for fundraising activities on the part of the Grantee to provide matching funds for the project;
4. Whereas, the State budget crisis significantly reduced the funds that were made available to the Clean Water Management Trust Fund, and the Fund is still managing the affects of that budget cut; and
5. Whereas, phasing of funding for certain projects would allow the Grantee to begin work on the project, but would not encumber Clean Water Management Trust Fund funds that the Grantee will not need or use for several years, and would enable the Board to direct more of the funds toward projects that are ready to proceed immediately.
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE CLEAN WATER MANAGEMENT TRUST FUND MEETING IN RALEIGH ON DECEMBER 10, 2002:
1. The Board of Trustees authorizes the following project phasing scenarios:
A. For all projects that include planning, design, permitting and construction, the projects may be phased as follows: · Phase 1 – Project Planning · Phase 2 – Prepare Final Plans and Specifications and Obtain All Necessary Permits · Phase 3 – Construction Phase I · Phase 4 – Construction Phase II · Phase 5 – Construction Phase III · Phase 6 – Monitoring if/as required by Grant Agreement
B. For the acquisition of land or conservation easements that can be acquired in phases, the project may include up to five phases.
2. The Clean Water Management Trust Fund will encumber funds for only the phase of the project specified in the contract agreement. The availability of funds to be encumbered for future phases will depend upon:
3. The Grantee shall request, in writing, each future phase of funding from the Clean Water Management Trust Fund. The request shall reach the Raleigh office of the Clean Water Management Trust Fund at least 3 months prior to the funds being required by the Grantee.
4. Upon receipt of the request for future phase funds from the Grantee, the Board of Trustees shall establish the priority under which the funds shall be encumbered, in relation to other Clean Water Management Trust Fund projects awaiting funding.
5. The future phases of funding shall be made only for the originally approved project scope. Any changes in project scope proposed by the Grantee must be reviewed and approved by the Board of Trustees, and changes are not included in the future phases of funding unless specifically approved by the Board of Trustees.
6. The future phases of funding shall total the amount of the grant originally approved and may not exceed the amount of the grant originally approved. Any change in grant total amount proposed by the Grantee must be reviewed and approved by the Board of Trustees, and changes are not included in the future phases of funding unless specifically approved by the Board of Trustees. If the Board of Trustees approves changes to the grant total amount, the Board shall establish the priority under which the additional funds shall be encumbered, in relation to all other Clean Water Management Trust Fund projects awaiting funding.
