pm B. 2001B-017 – The Nature Conservancy’s Bear Garden
Project – Bill Holman (Action Item)
The Board of Trustees of CWMTF approved a grant of up to $7.9 million
to The Nature Conservancy to acquire the 14,391-acre Bear Garden tract
in Pender County in the Cape Fear River Basin on January 13, 2003.
On January 30, 2003 The Nature Conservancy wrote CWMTF to advise CWMTF
that it had sold a 287.5-acre parcel to a conservation buyer, that it
may not be able to transfer most of the property to a state agency, that
it may wish to sell other tracts totaling 1500 acres to other conservation
buyers, and other issues.
CWMTF staff considers TNC’s
request to be a significant change in the project reviewed and approved
by the Board on January 13, 2003
and seeks additional guidance from the Acquisition Committee and Board
of Trustees.
1:50 pm C. 2002A-020 – NC Coastal Land Trust’s Lockwood’s
Folly Project – Bill Holman (Action Item)
The Board of Trustees of CWMTF approved a grant of up to $652,000 to
the NC Coastal Land Trust to acquire the 263-acre tract on the Lockwoods
Folly River in Brunswick County in the Cape Fear River Basin on December
10, 2002. The Board required the entire tract to be placed under a state
conservation easement to address concerns about matching funds and to
provide more protection for the property.
On February 3, 2003 the NC Coastal Land Trust wrote CWMTF to raise
concerns about the proposed grant condition and to recommend an alternative.

pm D. 2001B-008 – City of Graham’s Haw River Greenway
Project – Francine Durso (Action Item)
The Board of Trustees of
CWMTF approved a grant of up to $140,000 to the City of Graham to acquire
22.3 acres encompassing seven tracts in
fee simple. The City’s application stated that they would purchase
the tracts for their tax value in lieu of appraisals. The tax value of
the tracts ranges from $4,000 to $69,000; four tracts are greater than
$10,000 in value; the last valuation was performed in 2000. While drafting
the contract, it was found that the CWMTF Appraisal Policy only allows
tracts to be purchased for their tax value up to $10,000. CWMTF staff
recommends that the appraisal policy limit of $10,000 be waived in this
case and that the City of Graham not be required to have appraisals prepared
on the four tracts that are greater than $10,000 in tax value.

pm E. 1998B-006 – Wildlife Resources Commission Goose Creek
Project – Francine Durso (Action Item)
This $1.8 million grant originally
involved acquiring riparian buffer easements and improving the buffers,
purchasing options on key forested
tracts, restructuring agricultural drain fields, stormwater planning,
a point source removal feasibility study, and community outreach. Goose
Creek contains the federally endangered Carolina heelsplitter mussel.
WRC has spent $400,000 to date. WRC has encountered obstacles on this
project and since last summer, WRC staff has been working to modify the
project’s scope. WRC wrote to CWMTF on Dec. 17, 2002 with the proposed
modifications. The major changes include deleting acquiring the options,
and using those funds ($240,000) instead to continue a water quality
and stream bank erosion study on Goose Creek, that is currently being
conducted by UNC-Charlotte for the NCDOT to assess the habitat of the
heelsplitter ($40,000) and developing a watershed assessment and management
plan to help develop site-specific management strategies in the watershed.
CWMTF staff recommends that modifications to the scope of work be approved.
The project will expire Dec. 31, 2003. Staff recommends that the contract
be extended until Nov. 30, 2005 with the stipulation that the contract
will not be extended past that date.
