The Board of Trustees of CWMTF will meet August 8-9 in Burke County, September 12-13 in Kinston, October 10-11 in Greensboro, and November 14-15 in Raleigh. The Board will review restoration and stormwater projects in August, review land acquisition projects in September, review infrastructure/wastewater projects in October, and set priorities for 2004B projects in November.

Other Announcements

1:10 pm I-B. Town of Bladenboro’s Land Application Project (2001B-501) – Francine Durso (Action Item)

In November 2002 the Board approved a grant of up to $1,863,000 to the Town of Bladenboro in Bladen County in the Lumber River Basin to reduce its discharge into Bryant Swamp and to construct a new wastewater land application system including the purchase of a 135-acre site for the spray field. The Town may discharge up to 500,000 gallons per day (gpd) under its current NPDES permit. As approved by the Board, the project was to dispose of 250,000 gpd on the spray field and the Town would only use the NPDES permitted discharge for flows that exceeded 250,000 gpd. The Town has since conducted a geotechnical review of the site and finds that they can dispose of only 200,000 gpd on the spray field. The Town’s engineer, Engineering Services, wrote CWMTF on June 11, 2004 and asked that the contract be revised to allow the disposal of only 200,000 gpd and to make other changes. CWMTF staff recommends that the Board approve the Town’s request because the project will still help improve water quality in the Lumber River Basin.

1:20 pm I-C. Town of St. Pauls Wastewater Treatment Plant Improvement Project (2001A-509) – Francine Durso (Information Item)

In November 2001 the Board approved a grant of up to $296,000 to the Town of St. Pauls in Robeson County in the Lumber River Basin for construction of a new clarifier and equalization basin at its wastewater treatment facility. The majority of the CWMTF funds were to be used for the clarifier. The Town later modified the design to include a sludge belt press instead of the equalization basin. The Town matched CWMTF’s grant with $73,700 for a total budget of $369,700. The Town bid the project on June 8, 2004. The low bid was $756,000. The Town rejected all bids on June 10 and authorized its engineer, Koonce, Noble & Associates, to redesign the project and delete the sludge belt press. The Town hopes to rebid the project on July 20. CWMTF’s contract with the Town will expire on December 31, 2004. CWMTF staff will work with the Town to extend this contract if the Town receives bids for the project that it can afford.

1:25 pm I-D. Town of Askewville Centralized Sewage Collection System Project (2000B-601) – Francine Durso (Information Item and Action Item)

In November 2001 the Board approved a grant of up to $305,000 to the Town of Askewville in Bertie County in the Roanoke River Basin as matching funds for a $2,739,000 Rural Center grant for the construction of a new centralized sewage collection and treatment system to eliminate failing septic tanks. The Town bid the project on April 13, 2004, and the low bid exceeded the grant funds by $2.1 million. The Town reduced the scope of the project and negotiated a new total project cost of $3,754,5000 with the low bidder. This exceeds grant funds by $710,500.

The Town’s engineer, McDavid Associates, wrote CWMTF on May 26 requesting an additional $400,000 from CWMTF. The Town also requested an additional $310,500 from the Rural Center. The Rural Center considered the Town’s request on June 24, and did not approve additional funds.

CWMTF staff recommends the following options to the Board: (1) require the Town to provide 10% of the total project costs or $375,450 and approve an additional $335,000 of CWMTF funds, (2) require the Town to provide 20% of the total project costs or $750,900 and not approve additional funds from CWMTF, or (3) defer this request so that it can be considered with other 2004B infrastructure/wastewater projects at the October 2004 Board meeting. CWMTF’s contract with Askewville expires on December 31, 2004.

1:35 pm I-E. Camden County Land Application Project (2001B-502) – Francine Durso (Information Item)

In January 2003 the Board approved a grant of up to $438,000 to Camden County in the Pasquotank River Basin for the design and permitting of a new land application system, serving as matching funds for a $3,000,000 Unsewered Communities Rural Center grant. The Board has committed additional construction funds up to $2,162,000 once the County receives all permits for the project. In May 2004 Camden County requested a modification in the scope of the project. The Rural Center, CWMTF, and the County met on June 10 to discuss the status of the project. The change in scope includes relocation of the wastewater treatment plant and spray irrigation site much further north than originally proposed, and a reduction in wastewater treated from nearly 200,000 gallons per day to 100,000 gallons per day. Some local citizens oppose the location of the plant in their community and have contacted the Rural Center and the DENR/Division of Water Quality to express their concerns. The County Commissioners will meet on July 19 to make the final decision on the location of the plant. CWMTF staff seeks guidance from the Board as to whether the reduction in treatment volume and/or the location of the plant and spray field are a concern to the Board. The County has already purchased the spray field site (325 acres for $1.3 million or $4000/acre) and the plant site (15 acres for $75,000 or $5000/acre). The County is preparing a revised project budget for the Rural Center and CWMTF.

1:45 pm I-F. City of Bessemer City Wastewater Project (2000B-501) – Francine Durso (Action Item)

In 2001 the Board approved a grant of up to $2,000,000 to the City of Bessemer City in Gaston County in the Catawba River Basin to connect its wastewater collection system to Gastonia. On February 16, 2003 the Board approved a request from the City to use approximately $903,000 of its $2 million grant to replace 13,750 feet of existing sewers constructed in the 1920’s that are deteriorated and/or collapsed, causing excessive infiltration/inflow into the wastewater collection system. On June 25, the City’s engineer, Pease Associates, wrote CWMTF requesting that they be able to use approximately $1,231,700 for 15,635 feet of sewer system replacement because the other portions of the project have now been completed and these funds could be available to apply to the sewer replacement work. CWMTF staff notes that this request is consistent with the use of CWMTF funds but is a significant change from the original project scope which included little funds for sewer replacement. This contract expires July 31, 2004.

2:00 pm I-G. DENR’s WaDE Program (2001A-603) – Tom Massie (Action Item)

In November 2001 the Board approved a grant to the DENR/Division of Environmental Health’s Wastewater Discharge Elimination (WaDE) Program for up to $1.2 million over 3 years to fund: (1) five survey technicians; (2) financial assistance to County Environmental Health Programs to permit and inspect systems; (3) assistance for local loan/grant programs to low-income homeowners; and (4) development of a GIS tracking system. WaDE wrote CWMTF on June 23, 2004 and requested that $191, 603 be transferred from Items 2 and 3 into Item 1 in order to retain experienced surveyors, upgrade one position, and hire temporary surveyors to increase the number of homes that can be surveyed. CWMTF staff recommends that the Board approve the transfer of funds because it is consistent with the use of CWMTF funds for surveyor’s direct costs (not Division overhead) and will allow the important survey work of the WaDE program to continue uninterrupted. This contract expires June 30, 2005.

2:05 pm I-H. 2004B-504 – Town of Colerain’s Emergency Generator – Damon Tatem (Action Items)

On June 1, 2004 the Town of Colerain in Bertie County in the Chowan River Basin requested $17,000 to purchase an emergency generator for its pump station. The Town’s request is consistent with the guidelines adopted by the Board at its May 2004 meeting in Raleigh regarding emergency generators.

CWMTF staff recommends that the Board approve up to $17,000 to the Town of Colerain to purchase an emergency generator.

CWMTF staff further recommends that the Board set aside $100,000 in fiscal year 2004-2005 to assist local governments with the purchase of emergency generators consistent with the guidelines adopted by the Board at its May 2004 meeting.

2:10 pm I-I. Storm Damage in Eden – Bern Schumak (Information and Potential Action Item)

The Town of Eden in Rockingham County in the Dan/Roanoke River Basin suffered a devastating flood in June. The flood damaged sewer lines and other infrastructure. CWMTF staff recommends that the Town of Eden be allowed to submit an emergency application for the 2004B Cycle to be considered at the October 2004 Board meeting.

CWMTF staff recommends that the Board allocate $200,000 in fiscal year 2004-2005 to continue its Mini-Grant Program to pay 80% of the transaction costs associated with the development of acquisition projects to protect high quality waters and to restore impaired waters.

4:10 pm K-C. 2004M-001 – Land Trust for the Little Tennessee’s Request for Multiple Tracts on the Little Tennessee River – Tom Massie (Action Item)

On May 10, 2004 the LTLT requested $25,000 for transactional costs associated with the pre-acquisition costs of five tracts along the Little Tennessee River in Macon County: conservation easements on a 46 acre (7,700 ft. stream) and a 17-acre (2,500 ft. stream); fee simple purchase of a 16-acre (2,100 ft. stream), a 29-acre (950 ft. stream) and a 25-acre (1,600 ft. stream) tract. LTLT’s request presents these tracts as priorities, but would like to be able to apply funds to other tracts should the opportunities present themselves. CWMTF has reviewed the request, believes it is consistent with the Board’s policy, and recommends that the Board approve up to $25,000 for the specific tracts listed, with additional tracts to be submitted as new applications.

4:15 pm K-D. Funding For Donated Easements – Francine Durso (Action Item)

The Board established a new program to pay for the transaction costs associated with the donations of conservation easements to protect water quality in 2003. CWMTF staff recommends that the Board allocate $200,000 in fiscal year 2004-2005 to continue its Donated Easement Program.

4:20 pm K-E. 2003D-011 -- Lumber River Conservancy’s Singleton Bay Tract in Hoke County – Nancy Guthrie (Action Item)

On January 30, 2004 the Lumber River Conservancy requested up to $15,350 to pay transaction costs associated with the donation of fee simple ownership by William D. Singleton of 429 acres known as the Singleton Bay Tract in the Lumber River basin in Hoke County. The Lumber River Conservancy will hold the title. At its March 15, 2004 meeting the Board approved up to $4,500 for the survey work because there were not enough funds remaining for donated easements in the fiscal year 2003-2004 budget. The Board also approved considering the balance for funding in July 2004. CWMTF staff recommends that the Board approve funding for up to an additional $10,850 to fund the remainder of the transaction costs associated with the fee simple donation of this property.

4:25 pm K-F. 2004D-001—Blue Ridge Rural Land Trust’s Stack Tract on the South Fork of the New River – Bern Schumak (Action Item)

On April 16, 2004 the BRRLT requested up to $25,000 for transaction costs associated with the donation of a conservation easement on 69-acre Stack property along the South Fork of the New River in Watauga County. BRRLT will hold the easement. Agricultural and forest management practices may continue under appropriate best management practices. CWMTF staff has reviewed the request, believes it qualifies, and recommends funding up to $25,000.

4:30 pm K-G. 2004D-002 – Blue Ridge Rural Land Trust’s Chanlett Tract on Stillhouse Branch – Bern Schumak (Action Item)

On June 6, 2004 the BRRLT requested up to $25,000 for transaction and stewardship costs associated with the donation of a conservation easement on 80 acres in the Little River Subbasin of the New River in Alleghany County. BRRLT will hold the easement. Agricultural and forest management practices may continue under appropriate best management practices. CWMTF staff has reviewed the request, believes that it qualifies, and recommends funding up to $25,000.

4:35 pm K-H. 2004D-003 – Blue Ridge Rural Land Trust’s Coleman Tract on Handpole Branch – Tom Massie (Action Item)

On June 11, 2004 the BRRLT requested up to $25,000 for transaction and stewardship costs associated with the donation of a conservation easement on the 90-acre Coleman tract on Handpole Branch in the Toe River Subbasin of the French Broad River Basin in Avery County. BRRLT will hold the easement. Agricultural and forest management practices may continue under appropriate best management practices. CWMTF has reviewed the request, believes that it qualifies, and recommends funding up to $25,000.

4:40 pm K-I. 2002B-006 -- City of Charlotte’s Mountain Island Lake Acquisition – Francine Durso (Information Item)

In July 2003 the Board approved a grant of up to $250,000 to assist the City of Charlotte with the purchase of the 14-acre Parker property on Mountain Island Lake in Mecklenburg County in the Catawba River Basin valued at $1,019,000. The City had originally requested $500,000. The City purchased the tract in January 2004. On June 15 the City wrote CWMTF and declined the offer of the grant.

4:45 pm K-J. 2001A-014 – NC Coastal Land Trust’s Springer Point Project on Ocracoke Island – Bill Holman & Damon Tatem (Information Item)

In November 2001 the Board approved a grant of up to $2,016,000 to assist the NC Coastal Land Trust with the purchase of Springer Point on Ocracoke Island in Hyde County in the Tar-Pamlico River Basin. Hyde County is a Tier I County. The Board encouraged but did not require the seller or the buyer of Springer Point to provide a one-time payment of $86,654 to Hyde County to compensate the county for the loss of ad valoreum tax revenues. On May 11, 2004 NCCLT wrote CWMTF to note that two tracts on Springer Point continue to be taxed by the County and to request a reduction in the one-time payment to $64,123. .

NCCLT requested $2,160,561 from CWTMF on June 1, 2004 to help acquire the adjoining McWilliams tract on Ocracoke Island (CWMTF #2004B-032).

4:50 pm K-K. Sale of State-Owned Real Property – Joy Wayman (Information Item)

CWMTF needs to develop and adopt a process to follow regarding the sale of land under CWMTF’s conservation easements that is not needed to protect or restore water quality. For example the NC Coastal Federation may want to sell some of the Huggins Farm (CWMTF #2000A-008) in Onslow County on the White Oak River to a conservation buyer. The State Property Office oversees both the acquisition and sale of state-owned real property and easements and has developed and adopted policies.

In October 2003, the Board approved up to $12,000 to fund the cost of a “mail-out” customer survey to be developed by Dr. Toddi Steelman with NC State University, with oversight by the Long Range Planning Committee. CWMTF is negotiating a contract with NC State and staff wishes to clarify with the Committee and Board that the terms of the contract cannot abridge the University’s “right to publish” which could include the use of the data and information in support of a master’s thesis or other publications.
