On October 5, 2005, Attorney General Roy Cooper sent all state agencies an Advisory Opinion on compliance with the open meetings law. The opinion is self-explanatory and is included in board packet.
10:25 am J-2. Session Law 2005-454, Clarify Clean Water Funding – Frank Crawley & Bill Holman
Senator John Kerr introduced SB 1091, Clean Water Act of 2005, to increase and clarify funding for water infrastructure. The 2005 General Assembly removed the financing provisions but enacted and Governor Easley signed Senate Committee Substitute for HB 1095, Session Law 2005-454, Clarify Clean Water Funding, by Representative Gibson and Senator Kerr.
SL 2005-454 applies similar criteria and limits for grants for drinking water, wastewater treatment, collection system and stormwater quality projects funded by the Department of Environment & Natural Resources (DENR), Rural Center, and Clean Water Management Trust Fund.
SL 2005-454 amends CWMTF statutes covering the establishment and purposes of the fund, definitions and requirements for grants for wastewater treatment, collection systems and stormwater projects. Common criteria set forth in G.S. ¤ 159G-23 are given priority over the Board's criteria in awarding these grants. The amendments are effective for grants made after January 1, 2006. A copy of the Session Law is included in the board packet.
CWMTF has funded 178 wastewater and stormwater projects since 1997. Four were greater than $3,000,000:
- 1998A-304 – Johnston County Wastewater Reuse Project ($3,800,000)
- 1998B-504 – City of New Bern Wastewater Treatment Polishing ($6,589,000)
- 1998B-706 – City of Washington Constructed Wetlands ($4,073,000)
- 2000B-705 – Town of Lake Waccamaw Stormwater Management System ($4,500,000)
CWMTF staff recommends that the Criteria Committee review SL 2005-454 and recommend changes to CWMTF criteria, if any, to the Board, starting with applications received on June 1, 2006 (2006B Fall Cycle). CWMTF staff will consider the criteria set out in SL 2005-454 when it reviews 2006A Spring Cycle applications.
Wastewater grants from the NC Division of Water Quality and from the NC Rural Economic Development Center have been capped at $3,000,000 since 1998.

Chairman Howard has determined that setting priorities for funding 2005B Fall Cycle Projects is the priority for the November Board of Trustees meeting. Other committee work may be postponed to provide adequate time for committee and Board decisions on prioritizing and funding projects.

On November 13, 2002, the Board approved a grant of up to $4,600,000 to assist the NC Aquarium Society with the acquisition of Jennette's Pier and associated property in the Town of Nags Head in the Pasquotank River Basin. The NC Aquarium Society, CWMTF, Dare County, Nags Head, and the NC Department of Transportation (DOT) planned to eliminate stormwater outfalls into the ocean and sound near the property.
Nags Head and Dare County committed a total of $1,000,000 to match CWMTF funds for the project. Unfortunately DOT has declined to sign a memorandum of understanding (MOU) and to commit funds to construct the stormwater project.
CWMTF recommends that the Board approve the MOU and request funds from Nags Head and Dare County. CWMTF staff will continue to work with local officials and others towards construction of the stormwater project.

The Board also approved a grant of up to $1,310,000 for Farmville's Biosolids Reduction Project (CWMTF #2005A-504) at its October 10, 2005 meeting in Edenton. CWMTF staff recommends that the Board defer 2005B-402 until the 2006A Spring Cycle.

The CREP Committee met with DENR Secretary Bill Ross, Dan Oakley, and Richard Rogers on October 20, 2005.
The CREP Committee will present its recommendations to improve CREP and to reduce administrative costs. DENR and the CREP Committee have agreed to move from funding positions to funding transactions. DENR has proposed $1000 plus survey costs/transaction. DENR and the CREP Committee are still discussing the amount of costs per transaction and whether the costs per transaction should decrease on July 1, 2006 at the beginning of the 2006-2007 fiscal year.

In July 2004, the Board approved a grant of up to $1,063,000 to the Town of Fair Bluff in the Lumber River Basin in Columbus County for the Town to transfer the its wastewater to Fairmont's regional wastewater treatment plant (WWTP) and remove the Town of Fair Bluff's 0.23 MGD WWTP discharge from the Lumber River. To date, the Town has spent $46,400 in CWMTF grant funds. The Town's engineering consultant is Hobbs, Upchurch & Associates.
On September 13, 2005 the Town wrote to CWMTF to request an additional $1,000,000 for the project. CWMTF staff recommends that the Board approve expansion of the scope of the project to include upgrading pump stations and forcemains, and to cover anticipated cost overruns.
The NC Rural Economic Development Center is funding downstream wastewater system improvements in the Cerro Gordo/ Boardman aspect of the project which is also experiencing cost overruns (this project has already been bid). The Rural Center has suggested that the best course of action may to be completely sewer Boardman, and then obtain additional funds to sewer Cerro Gordo.
2:45 pm N-C. 2004B-511 – City of Lexington's Wastewater Reuse Project – Request for Additional Funds – Bern Schumak (Action Item)
In November 2004, the Board approved a grant of up to $972,000 to the City of Lexington in the Yadkin River Basin in Davidson County for the City to ÒscalpÓ 300,000 gallons per day, seasonally, from an outfall, treat it to reuse standards, and apply it to the city golf course. To date, the City has spent $62,155 in CWMTF grant funds. The Town's engineering consultant is Willis Engineers. The City bid the project on October 20, 2005 and wrote to CWMTF on October 27 to request an additional $233,731 for the project. The City is providing $983,699 in matching funds. CWMTF staff recommends that the Board approve the City's request up to $234,000 so that the complete scope of work for the project can be completed.
2:55 pm N-D. 2002B-603 – Town of Dover Collection System Construction – Leland Heath (Information Item)
In July 2003, the Board approved a grant of up to $333,000 to serve as matching funds for a NC Rural Center Grant of $3,000,000 to eliminate wastewater discharges from 279 septic tanks and/or straight piping disposal systems by construction of a new sewage collection system and pumping the wastewater to the City of Kinston's WWTP.
On October 12, 2005, the Town wrote the NC Rural Center to advise of cost overruns and the need to potentially reduce the planned service area in order to eliminate some of the construction and to reduce project costs. To date, Dover has not spent any CWMTF funds.

At its October 2005 meeting the Board voted that up to $2,796,000 would remain eligible for CWMTF #2005B-515 – Tuckaseigee Water & Sewer Authority's Wastewater Collection System Rehabilitation Project in Jackson County.

In 2000 the Board of Trustees of CWMTF provided a grant of up to $2,135,000 to the NC Coastal Federation (NCCF) to acquire 775 acre Huggins Farm on the White Oak River in Onslow County. The tract included wetlands, riparian buffers and uplands. The Board encouraged NCCF to sell the uplands to conservation buyers and reinvest funds from the sale to acquire other properties along the White Oak River.
On September 23, 2005 the NC Wildlife Resources Commission (WRC) wrote CWMTF to request that the property be transferred from NCCF to WRC to be added to the Game Lands Program instead of being sold to conservation buyers. NCCF is willing to transfer the property to WRC or to try to sell it. CWMTF staff recommends that the Board approve WRC's request.
3:40 pm O-C. 2005M-005 – The Land Trust for the Little Tennessee's Fisher Creek Tract in Jackson County – Tom Massie (Action Item)
On Sept. 21, 2005, the CWMTF received a request from The Land Trust for the Little Tennessee (LTLT) for $13,000 for transactional costs associated with the pre-acquisition costs for a 1,200-acre tract owned by the Town of Sylva on which the Town may be interested in selling a conservation easement. The tract has approximately 7392 linear feet of riparian land. CWMTF staff has reviewed the request, believes it is consistent with the Board's policy, and recommends that the Board approve up to $25,000 for the pre-acquisition transactional costs.
If the Board approves LTLT's request, $75,000 will remain available for Mini Grants for fiscal year 2005-2006.
3:45 pm O-D. 2005M-006 – Triangle Greenways Council's Joe Lee Tract on Walnut Creek, Wake County – Leland Heath (Action Item)
On Sept. 22, 2005, the CWMTF received a request from Triangle Greenways Council for $13,600 for transactional costs associated with the pre-acquisition costs for a 30-acre tract located on Walnut Creek and Big Branch in Wake County. The tract has approximately 3,000 linear feet of riparian land on one side of the creeks. CWMTF staff is still reviewing TGC's request and will make a recommendation at the Board meeting.
If the Board approves TGC's request, $50,000 will remain available for Mini Grants for fiscal year 2005-2006.
3:50 pm O-E. 2005M-007 – New Hanover County Soil & Water Conservation District's Hewlett's Creek Watershed Mini-Grant Request – Tom Jones (Action Item)
On October 27, 2005, New Hanover Soil & Water Conservation requested a mini grant for $25,000 to use for pre-acquisition costs for Òapplicable lands throughout the Hewlett's Creek WatershedÓ and also that the mini-grant term be 2 to 3 years.
When the Board established its mini-grant program, it required identification of a specific tract with a willing seller and a term of one year. CWMTF staff recommends that the Board not fund New Hanover Soil & Water Conservation District's request because willing sellers have not been identified. CWMTF staff further recommends that New Hanover SWCD apply to CWMTF in December for a riparian corridor conservation planning grant for work in the Hewlett's Creek watershed.

3:55 pm O-F. 2005M-008 – New Hanover County's Harrell and Smith Tracts on Smith Creek – Tom Jones (Action Item)
On October 28, 2005, the CWMTF received a request from New Hanover County for $25,000 for transactional costs associated with the pre-acquisition costs for the 31-acre Harrell Tract on Smith Creek which has approximately 2,600 linear feet of riparian land, and costs related to the donation of the 14-acre Smith Tract which has approximately 400 linear feet of riparian land on Smith Creek and an additional 1,000 linear feet on an unnamed tributary. CWMTF staff has reviewed the request, believes it is consistent with the Board's policy, and recommends that the Board approve up to $25,000 for the pre-acquisition transactional costs for the Harrell Tract and the costs related to donation of the Smith Tract.
If the Board approves this request, no funds will remain available for Mini Grants for fiscal year 2005-2006.
4:00 pm O-G. 2005D-013 – Carolina Mountain Land Conservancy's Linneman Tract in Upper Green River Watershed, Henderson County – Tom Massie (Action Item)
On September 26, 2005, the CWMTF received a request from Carolina Mountain Land Conservancy (CMLC) for a donated easement grant of $13,725 to fund the transactional costs associated with the donation of a 58.7-acre conservation easement with over 3,500 linear feet of riparian land on two un-named tributaries. The owner wishes to exclude several future homesites from the easement. CMLC will hold the conservation easement. CWMTF staff has reviewed the request, believes it is consistent with the Board's policy, and recommends that the Board approve CMLC's request up to $13,800.
If the Board approves CMLC's request, $222,400 will remain available for donated easement grants in fiscal year 2005-2006. CMLC has received 2 previous donated easement grants from CWMTF.
4:05 pm O-H. ÒAdvanceÓ Funds for Clean Water/Military Protection COPS Projects – Bill Holman (Information and Action Item)
At its meeting on October 9, 2005, the Committee approved the following but did not report it on October 10, 2005 for Board action. CWMTF staff recommends that the Committee report this action to the Board on November 14, 2005:
CWMTF will request that the Office of State Budget and Management (OSBM) and the State Treasurer provide funds to close portions of the following projects with Series 2005A Certificates of Participation because some of the other projects authorized by Session Law 2004-179 are progressing more slowly than expected: 1) 2005A-012 – NC Coastal Land Trust's Cherry Point/Piney Island project; and 2) 2005A-020 – NC Wildlife Resources Commission's Beck 2 at Folkstone project.
In addition CWMTF will request that OSBM allow CWMTF to use of some of the funds appropriated by the General Assembly to prevent encroachment by incompatible development in Session Law 2005-276 (2005 Appropriations Act). The 2005 General Assembly appropriated $2,000,000 to OSBM for military support. If OSBM does not approve CWMTF's request, CWMTF staff recommends that the Board approve payment of transaction costs up to $20,000 associated with NC Coastal Land Trust's Cherry Point/Piney Island project (#2005A-012) from funds appropriated to CWMTF. The Wildlife Resources Commission is responsible for paying for transaction costs associated with their projects.
4:10 pm O-I. 2005A-012 – NC Coastal Land Trust's Cherry Point/Piney Island Protection Project – Damon Tatem (Action Item)
On August 8, 2005 the Board approved the use of up to $3,000,000 in special indebtedness (COPS) to help protect water quality and to help protect Marine Corps Air Station Cherry Point in Craven County in the Neuse River Basin from encroachment by incompatible development. NCCLT provided a list of tracts that they planned to acquire.
On October 4, 2005 NCCLT wrote CWMTF to request that a 43-acre property owned by Mr. William P. Boulia in the air installation compatible use zone (AICUZ) be added to the tracts eligible for funding from CWMTF Project #2005A-012.
CWMTF staff recommends that the Board approve the use of CWMTF funds to help acquire the Boulia tract for a future stormwater project with the condition that CWMTF will pay up to 50% of appraised value. Funds from the Marine Corps, Town of Havelock, and other sources can be used as match.
4:15 pm O-J. Clean Water/Military Protection Projects – Bill Holman (Action Items)
At its August 7-8, 2005 meeting, the Board deferred the following clean water/military protection projects pending action by the Boards of the Natural Heritage Trust Fund and the Parks & Recreation Trust Fund and the Ecosystem Enhancement Program later this year. Those programs have taken action and have funded these projects. CWMTF staff recommends that the Board not fund these projects since they have been funded by other programs:
1) 2004B-036 – NC Division of Parks & Recreation's Carvers Creek I/Clark I at Fort Bragg/Pope ($2,331,000)
2) 2005A-009 – The Nature Conservancy's Corbett tract at Camp Lejeune ($1,516,000)
3) 2005A-025 – NC Wildlife Resources Commission's Upchurch tract on Nicholson Creek at Fort Bragg/Pope ($714,000)
4) 2005A-028 –Sandhills Area Land Trust's Glenn tract on the Little River at Fort Bragg/Pope ($67,000)
4:20 pm O-K. 2005B Deferred Fall Cycle Acquisition Projects – Bill Holman (Action Items)
1) 2005B-008 – Durham County's Erwin Trace and Penny tracts ($1,112,000). The Board requested additional information about this project at its October meeting.
2) 2005B-018 – Land Trust for Little Tennessee's Welch Farm tract ($86,650). LTLT has requested withdrawal of this project.
4:30 pm O-L. 2005B Fall Cycle Acquisition Project Changes – CWMTF Staff (Action Items)
1) 2003A-032 – NC Wildlife Resources Commission's GMS Tract ($6,250,000). CWMTF staff recommends that this project be funded at up to $6,250,000 in fiscal year 2006-2007 subject to a signed contract with the landowner and commitment of matching funds.
2) 2005B-004 – Carolina Mountain Land Conservancy's McLain Branch Farm ($139,000). CWMTF staff recommends that the Board not fund this project. CWMTF staff would support donation, not acquisition, of riparian buffers on this conservation development project.
3) 2005B-010 – Foothills Conservancy of NC's Catawba Northbend Tract ($1,653,000). CWMTF staff recommends that this project be deferred until the 2006A Spring Cycle. CWMTF staff encourages Foothills to sign a contract with the landowner and seek commitments of matching funds.
4) 2005B-011 – Foothills Conservancy of NC's Johns River Confluence Tract #1 ($3,952,000) and 2005B-012 – Foothills Conservancy of NC's Johns River Confluence Tract #2 ($1,358,000). CWMTF staff recommends that these projects be funded at up to $3,952,000 and $1,358,000, respectively, in fiscal year 2006-2007 subject to a signed contract with the landowner and commitment of matching funds.
5) 2005B-013 – Land Trust for Central NC's David Springer's Point Farm Project ($612,000). CWMTF staff recommends that the Board defer this project until the 2006A Spring Cycle.
6) 2004B-021, 2005B-019, 2005B-021 – Lumber River Conservancy Projects. On October 12, 2005, the Lumber River Conservancy wrote to CWMTF regarding matching funds on one active and two pending projects. Increasing match increases the water quality score of projects. CWMTF staff recommends that:
a) The budget for active CWMTF Project #2004B-021 – Upper Lumber Tracts be reduced by $153,000 because a landowner has decided not to sell.
b) The budget for CWMTF Project #2005B-019 – Hunt tract be amended to show $129,514 in matching funds from LRC.
c) The budget for CWMTF Project #2005B-021 – Slaughter tract be amended to show $38,686 in matching funds from LRC.

Grants between CWMTF and other state agencies are much quicker to encumber and administer. Since the properties will ultimately be held in fee simple by the state agency, CWMTF staff recommends that the Board approve transferring grants from land trusts to state agencies when a land trust is acquiring land in fee on behalf of a state agency such as the Wildlife Resources Commission or Division of Parks & Recreation and when the land trust requests the change. If the Board approves this recommendation, CWMTF staff will report the changes to the Board at future meetings.
CWMTF staff considers a change in the name of the applicant to be a significant change and require approval of the Board.
