10:45am I. Town of Emerald Isle (2000B-703) – Francine Durso & Damon Tatum (Action Item)

On September 2, 2003 the Town of Emerald Isle wrote CWMTF to request that the Town be able to use 1.1 acres of the 43.2-acre tract acquired with CWMTF funds as the location of a new elevated water tank. CWMTF granted Emerald Isle $2.4 million toward the purchase of the tract for the purpose of constructing a wetlands to reduce stormwater pollution into the outstanding resource waters and shellfishing waters of Bogue Sound (ORW and SA). The State of North Carolina received a conservation easement on the tract to protect its investment in the project. CWMTF’s standard conservation easement prohibits construction of a water tank. CWMTF recommends that the Board table the Town’s request until its October 20, 2003 meeting so that staff can learn more about measures the Town is willing to take to mitigate the impact of the water tank on the park and to further reduce stormwater pollution in Town.

10:55 am J. 2003M-002 – Sandhills Area Land Trust’s Request for a Mini-Grant for Methodist College’s River Tract in Fayetteville – Nancy Guthrie (Action Item)

On July 1, 2003 the Sandhills Area Land Trust (SALT) requested a Mini-Grant of up to $25,000 to pay for transaction costs associated with the acquisition of a conservation easement on Methodist College’s approximately 92-acre River Tract on the Cape Fear River in Fayetteville. The NC Wetlands Restoration Program (WRP) may restore some of the Methodist College property. CWMTF staff has reviewed the request, believes that it qualifies, and recommends that the Board approve SALT’s request.

11:05 am K. 2003M-004 – Haw River Assembly’s Request for a Mini-Grant for Haw River tracts in Alamance County – Nancy Guthrie (Action Item)

On August 25, 2003 the Haw River Assembly requested a Mini-Grant of up to $25,000 to pay for appraisals, site assessments and other transaction costs associated with the acquisition of conservation easements on 6 tracts, providing over 28,000 linear feet of riparian buffer on the Haw River and Cane Creek. CWMTF staff has reviewed the request, believes that it qualifies, and recommends that the Board approve the request, with the condition that CWMTF staff will work with the Haw River Assembly to prioritize the work on the tracts, in the likely event that the mini-grant funds are not adequate to cover all anticipated work on all 6 tracts.

The Dan River Basin Association has invited CWMTF Trustees (Acquisition Committee members will be in a committee meeting.) and guests to paddle a section of the Dan or Smith Rivers and/or to tour a proposed greenway along the Dan River on Sunday, September 21, 2003. Please meet at the Hampton Inn in Eden at 2:00 pm.

CWMTF staff will meet after the Board meeting on Monday, September 22, 2003.

The Board of Trustees of the Clean Water Management Trust Fund will review wastewater projects at its October 19-20 meeting in Jacksonville. The Board will set priorities for its 2003A Cycle at its November 17-18 meeting in Raleigh.

CWMTF, NC Wildlife Resources Commission, DENR, The Nature Conservancy, and the US Marine Corps will celebrate conservation of the Beck tract (CWMTF Project #2001B-036) in Onslow County on Tuesday, October 21, 2003 (the morning after the CWMTF Board meeting in Jacksonville).

The next deadline for applications for grants from the Clean Water Management Trust
Fund is December 1, 2003 (2003B Cycle).

The Board of Trustees of the Natural Heritage Trust Fund will meet on September 25, 2003 at The Rural Economic Development Center in Raleigh. The next deadline for applications for grants from the Natural Heritage Trust Fund is February 8, 2004.

The State Property Office adopted a policy adopted regarding payment of
overhead expenses to non-profit conservation organizations on August 13,
2003.

11:15 am C. Matching Federal Farmland Preservation & Forest Legacy Funds Pursuant to the State Budget Bill – Bill Holman (Information Item)

Section 11.8(b) of HB 397, 2003 Appropriations Act, provides “Notwithstanding GS 113-145.3, for the 2003-2004 fiscal year only, the Clean Water Management Trust Fund Board of Trustees may allocate up to four million one hundred thousand dollars ($4,100,000) to match federal, State, local, and private farmland preservation and forestland preservation funds and to acquire permanent conservation
easements on working farms and forests.”

11:20 am D. The Nature Conservancy’s Response to The Washington Post – Bill Holman (Information Item)

In May 2003 The Washington Post ran a series of newspaper articles critical of some of The Nature Conservancy’s projects and practices. The Nature Conservancy’s Board of Governors has changed some of its policies and procedures.

11:30 am E. Proposed Language Prohibiting Use of CWMTF Funds in Eminent Domain Actions – Francine Durso (Action Item)

CWMTF staff recommends that the following language be inserted into all new contracts with local governments, including contracts approved by the Board at its July 2003 meeting in Raleigh: “Clean Water Management Trust Fund grant funds may not be used for any eminent domain litigation or any action or expenditure related to eminent domain, unless approved by the Board of Trustees of the Clean Water Management Trust Fund in writing prior to the action. The Board of Trustees shall review requests to use funds for eminent domain action on a case-by-case basis. Requests shall be provided in writing by the Grant Recipient.”

11:40 am F. CWMTF Policy on Property Tax Compensation for Certain Counties – Bill Holman (Action Items)

1) CWMTF staff recommends that the Board adopt a policy urging sellers and buyers of conservation lands in fee simple to compensate Tier I and Tier II counties with 30% or greater of the county’s land in fee simple conservation ownership up to ten times the annual property taxes on the subject property. CWMTF staff further recommends that CWMTF reimburse grantees for compensation to Tier I and Tier II counties with 30% or greater of the county’s land in fee simple conservation ownership. (See Draft Resolution.) According to DENR/Center for Geographic Information & Analysis the following counties were Tier I or II in 2003 and had 30% or greater of their land in fee simple conservation owenership: Swain, Graham, Hyde, and Tyrrell.

2) If the Board adopts a policy on compensation to certain counties, CWMTF staff recommends that the condition that the Board placed on 2002B-016 – NC Wildlife Resources Commission’s Needmore Project on the Little Tennessee River at its July 2003 meeting be made consistent with the Board’s policy.

CWMTF staff is continuing to work with land trusts to develop a standard approach to reasonable stewardship costs. CWMTF staff counts stewardship costs as matching funds when appropriate.

12:45 pm M. 1998B-017 – Land Trust for Central NC’s Request to Purchase Deal Tract on Grants Creek for Tax Value (Action Item) – Francine Durso

On June 26, 2003 the Land Trust for Central NC requested that CWMTF approve acquisition of an 18.21-acre tract on Grants Creek from Mr. Richard Deal for its current ad valorem tax value of $58,404. At its August 18, 2003 meeting the Board debated and re-referred LTCNC’s request to the Acquisition Committee for further review. CWMTF staff recommends that the Board approve LTCNC’s request.

12:50 pm N. Piedmont Land Conservancy’s Upper Mitchell River Acquisitions (2002A-026) – Bern Schumak (Action Item)

At its July 22, 2003 meeting the Board of Trustees approved a grant of up to $1,408,000 to the Piedmont Land Conservancy (PLC) to assist with the acquisition of the 766-acre Winebarger tract in the Mitchell River Watershed in Surry County in the Yadkin/Pee Dee River Basin. 2002A-026 is No. 15 on the July 2003 priority list for funding and is not yet under contract. On September 5, 2003 PLC wrote CWMTF requesting that $1,007,000 of this $1,408,000 grant be reallocated, if required, to the acquisition of two new tracts owned by G&G Lumber Company – the 1,781-acre Little Mountain tract and the 459-acre Len’s Knob tract. CWMTF staff believes that acquisition of the Little Mountain and Len’s Knob tracts has great merit. The Board approved Mini-Grant 2003M-003 to PLC to assist with acquisition of the tracts at its August 18, 2003 meeting. However, it is important for CWMTF not to set precedent by reallocating funds for new tracts from funds for tracts that were originally approved. CWMTF staff encourages PLC to apply to CWMTF for these two tracts in the Dec. 2003 application cycle, if needed. PLC is also seeking funds from DOT/DENR’s Ecosystem Enhancement Program to acquire these two tracts. The Board of Transportation may review PLC’s request at its October 8-9, 2003 meeting. CWMTF staff recommends that the Board not support PLC’s request. CWMTF staff will continue to explore options with PLC and may present an alternative to PLC’s request to the Board at its September or October meetings.

1:10 pm O. Transactional Costs for Donated Easements – Bill Holman (Action Item)

The Board of CWMTF has funded many projects to facilitate the donation of conservation easements to protect water quality. Donations of conservation easements proceed at the pace of the property owner. Some take years; many are driven by tax year and the state’s conservation income tax credit program. CWMTF staff recommends that the Board establish a new Mini-Grant for Donated Conservation Easements and set aside $200,000 per fiscal year to fund them (similar to the Board’s existing mini-grant program that pays for transaction costs associated with acquisition projects in certain watersheds). Applicants would be allowed to apply for the reimbursement of transaction costs, including staff time, for donated easements by a letter to the Board. CWMTF staff would review the applicant’s request to determine if the donation would protect or restore surface water quality and make a recommendation to the Board. The Board would review and vote to fund or not fund the request.

1:30 pm P. Blue Ridge Rural Land TrustTransfer of Transactional Costs on Donated Easements (2001B-002 and 2002B-003)(Proposed CWMTF Project No. 2003D-001) – Bill Holman, Bern Schumak & Tom Massie

On August 25 and 26, 2003 the Blue Ridge Rural Land Trust (BRRLT) wrote CWMTF requesting that transactional costs be allowed to be transferred among properties as follows:

1. 2001B-002: The Ward Tract #2 which comprised $35,500 (including stewardship) of this $188,000 grant will be funded instead by a NCDA Farmland Preservation Program grant to BRRLT. BRRLT requests that the $35,500 be applied instead to pay for transaction costs associated with the donation of a conservation easement on the 488-acre Tate Farm in Ashe County.

2. 2001B-002: The Love tract which comprised $27,600 (including stewardship) of this $188,000 grant will not be pursued by BRRLT and they request that the $27,600 be applied instead to pay for transaction costs associated with the donation of a conservation easement on the 81-acre Ketchum Tract on Piney Fork Creek in Ashe County (the Ketchum Tract is CWMTF Project 2003A-002, requesting $37,750).

3. 2002B-003 is No. 27 on the July 2003 priority list for funding and is not under contract. The Nunez tract which comprised $28,000 of this $128,000 grant will not be pursued by BRRLT and they request that the $28,000 be applied instead to pay for transaction costs associated with the donation of a conservation easement on the 96-acre Johnston Farm in Wilkes County (the Johnston Farm is part of CWMTF Project 2003A-001, requesting $36,450 for that portion of the project).

CWMTF staff recommends that the Board not support BRRLT’s request to reallocate funds from older grants to new projects that have not been fully reviewed by the staff and Board. CWMTF staff recommends that the Board establish a new Mini-Grant for Donated Conservation Easements to pay for transaction costs associated with donations of conservation easements that protect surface water quality and that the Board set aside $200,000 per fiscal year for this purpose. (See Agenda Item O.)

CWMTF staff has reviewed the tracts that BRRLT has proposed for conservation easements, determined that the proposed easements will protect surface water quality, recommends that the Board approve BRRLT’s request for reimbursement of transaction costs associated with the donation of conservation easements on the 96-acre Johnston Farm in Wilkes County (up to $36,500), the 81-acre Don & LeNore Ketchum tract in Ashe County (up to $37,800), and the 488-acre Tate Farm in Ashe County (up to $35,500) with a Mini-Grant for Donated Conservation Easements up to a total of $75,000. (CWMTF Project #2003D-001), and further recommends that the Board reduce the budgets of CWMTF Project Nos. 2001B-002 and 2002B-003 accordingly. CWMTF staff also recommends that BRRLT withdraw its request for 2003A-002.
